R-72-18 RESOLUTION VILLAGE OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION ORDERING PREPARATION OF PLKNS, LETTING OF BIDS, AND CONSTRUCTION OF STREET AND WATER SYSTEM IMPROVEMENTS PURSUANT TO PETITION OF THE OW14ERS OF THE LAND TO BE BENEFITED THEREBY AND ASSESSED THEREFOR WHEREAS, Walter N. Coppersmith and Ann C. Coppersmith, husband and wife, are owners of certain land in the Village of Lake Elmo described as follows: The East 735 feet of the West 1273 feet of the South 498.6 feet of the Southwest Quarter of the Southeast Quarter of Section 13, Township 29 North, Range 20 West, containing 8.4 acres, more or less, and WHEREAS, LEAD, INC., a Minnesota corporation, is owner of certain land in the Village of Lake Elmo, Washington County, Minnesota, des- cribed as follows: The South 498.6 feet of the West 538 feet of the Southwest Quarter of the Southeast Quarter of Section 13, Township 29, Range 21, containing 7 acres, more or less, and WHEREAS, said lands abut 31st Street in the Village of Lake Elmo, which street has been designated by the Village Council in its comprehensive plan as a limited access street; and WHEREAS, Coppersmiths have obtained a building permit for residential dwelling on their land on the condition that a new street extending North of 31st Avenue be extended as a means of access to their property and LEAD, INC. has obtained approval of a preliminary plan for development of its land on the condition that said new street be constructed to serve its plan; and WHEREAS, it is desire of both of said owners and the Village Council to cooperate in the construction of a new street so as to save unnecessary expenses of the owners, while at thesame time, preserving the village policy of limited access to 31st Street; and WHEREAS, Coppersmiths and LEAD, INC. have agreed to the following arrangements: Uj LO
