R-72-24 <br />RESOLUTION <br />VILLAGE OF LAKE ELF10 <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ESTABLIShIIVG A PROCEDURE FOR DETERMINING THE <br />ACREAGE OF BUILDING LOTS WITH RESPECT TO THE MINIMUM REQUIREMENTS <br />OF BUILDING CODE <br />WhEREAS, the ordinances of the Village of Lake Elmo regulating <br />building and subdivision of land provide that all residential building <br />lots within areas not served by municipal sewer and water must be at <br />least one acre in size. <br />WHEREAS, in addition to those health and welfare considerations <br />relating to density of population, one of the major purposes of said <br />one acre minimum size requirement for lots not served by municipal <br />sewer and water is to prevent pollution of ground water by limiting <br />the number of individual sewage disposal systems which will be con- <br />structed within a given area. <br />NOW, THEREFORE, BE IT RESOLVED by the Village Council of the <br />Village of Lake Elmo that the following standards shall be applied <br />in determining whether a particular lot meets the minimum lot size <br />requirements of the Village Ordinances: <br />1. In the case of all residential lots, the minimum lot size <br />requirement shall be determined by taking the dimensions of the lot <br />from the nearest right -of --way line of any abutting street or road <br />so that in determining the size of the lot no part of the right-of- <br />way of a street or road shall be included. <br />2.
