R-72-27 <br />RESOLUTION <br />V I LIAGE OF LAiZEE'LMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION GRANTING VARIANCE FROM THE PROVISIONS <br />OF THE VILIAGE SUBDIVISION ORDINANCE <br />WHEREAS, Agnes Berschens and John Berschens own certain real estate in the <br />Village of Lake Elmo, which said real estate is located in Government Lot No. 4, <br />Section 10, and is more specifically described in the Certificates of Survey an- <br />nexed hereto and made a part hereof as Exhibits "A" and "B"; and <br />WHEREAS, said owners wish to divide the said real estate into two lots for <br />use as single family residential building sites; and <br />WHEREAS, said owners have requested that the Village Council grant a vari- <br />ance from the provisions of the Village Subdivision Code which requires the plat- <br />ting of all such subdivisions; and <br />WHEREAS, the Village Council, having considered the Certificate of Survey <br />submitted by said owners and ahe report of the Village Engineer dated October <br />15, 1971, has determined that the proposed subdivision is of small size and of <br />minor importance, and situated in a locality where the conditions are well de- <br />fined, and as such, the owners may be granted the requested variance under the <br />provisions of Section 12(C) of the said Subdivision Code: <br />NOW, THEREFORE, BE IT RESOLVED, that said owners are hereby granted a vari- <br />ance from the provisions of the Subdivision Code of the Village of Lake Elmo in <br />that the subdivision of the real estate described in Exhibits "A" and "B" into <br />the two lots described in Exhibit "A" and Exhibit "B" respectively, is hereby <br />approved Without the need to plat the same. <br />PROVIDED, HOWEVER, that the variance herein granted shall be conditioned on <br />the said owners granting to the Village of Lake Elmo an easement for the proposed <br />66 foot road and the 24 foot drainage channel easement as shown on the said <br />exhibits. <br />BE IT FURTHER RESOLVED, that the variance granted herein is a variance <br />only from the platting requirements of the Subdivision Code, and shall not be <br />construed as a variance from any of the provisions of the Zoning and Building <br />Regulations or other applicable ordinances of the Village of Lake Elmo. <br />Adopted by the Village Council this .8th day of.- 1972. <br />Attest: <br />DONALD /MEHSIKOMKR, <br />Village Clerk <br />LVIN J.
