B. Reconsideration — Variances — Haire (8160 Hill Trams <br />At its March 21, 2006 meeting the City Council directed that this matter be placed on the <br />April 4, 2006 City Council agenda for reconsideration. On March 6, the Council adopted <br />a resolution denying the variances (lot area and OHW setback). Due to the change of <br />meeting night, a Monday rather than Tuesday, the applicants were not in attendance at the <br />Council meeting. The applicants requested, and the Council approved, to open the matter <br />for reconsideration. The burden is on the applicant to show a hardship. <br />Kevin and Gena Haire provided the Council a letter, dated March 29, 2006, to correct <br />false information in the City Planner's report from the March 21st Council meeting. A <br />power point presentation was made by Todd Ganz, Merit Custom Homes, of pictures of <br />homes built along Hill Trail North to show the size of the house is not out of scale or <br />character for the neighborhood and noted that other houses have, en granted variances <br />without concern for bedrooms. , <br />M/S/P DeLapp/Smith — to uphold the previous Council action in adopting Resolution No. <br />2006-024, A Resolution Denying Zoning Variances for Kevin and Gen6 Haire at 8160 <br />Hill Trail North. (Motion passed 3-]:Conlin stated.the applIuit stated th± rr case well and <br />showed that the house is not out of scale for the nghborhi"rod and place reasonable <br />findings could be placed that the septic system could stay", <br />tay sized for 3 bedrooms.) <br />C. CDBG Project Update — Cimarron•Gas Line Replacement <br />The City Planner reported that the city's consultanthotitied the City which specific <br />Cimarron units qualified for grant assistance; a new Request for Proposals was prepared <br />and sent to 15 plumbing firms here wexe no written proposals submitted. <br />Staff has been advised that the GountyCDBG consultant that HUD rules have been <br />modified which and the consultant needs to get a new Davis Bacon Wage determination <br />before we can start truer with the ve1"ior solicitation. There has been no indication from <br />the County CDBG staff that there is any issue with timing of grant fiuids expenditures. <br />Council member DeLapp prodded a copy of a letter he wrote to the Editor to rebut what <br />Peter Bell, Chairman of the Metropolitan Council, had said about an article by Pioneer <br />Press Assistant Editor Mark Yost. <br />The consensus of the council was they did not want to take official action on this letter <br />because this belongs as a personal response from Steve DeLapp, <br />10.
