Lake Elmo LAgendaection: Planning, Land Use and Zoning No. 9A <br />City Council — <br />April 18, 2006 <br />Agenda Item: Final Plat & Development Agreement — "Discover Crossing" <br />Background Information for April 18, 2006• <br />The City Council approved the OP Development Stage PIan, Preliminary PIat and OP Conditonal Use <br />Permit for this 28 lot neighborhood on August 16, 2005. The plat specified that no more than 25 lots be <br />platted as buildable lots, but that 3 potential future lots be platted as outlots pending OP density/zoning <br />amendments then contemplated during 2006. While those amendments have not as yet taken place, it <br />continues to appear that they will be undertaken for compliance with the recently approved Comprehensive <br />Plan in 2006. <br />This is the first OP plat for which we have submitted the Final Landscape Plan to the Cit<j r _'�st r fc� <br />recommendations. A copy of her review memo is attached. It is suggetesd that Final Plat approval be <br />subject to compliance with those recommendations in adtion to the normal conditions for final plats. The <br />Conservation Easements and HOA Declarations continue to be under construction/review by the City <br />Attorney and Minnesota Land Trust — normally not completed until after City Council Final Plat approval. <br />It appears that the Final Plat (and final construction plans as approved by the City Engineer) comply with <br />the provisions of Section 400 of the City (platting) and Section 301 (Open Space Development) as well as <br />the approved Preliminary Plat, including conditions of approval.
