4.07 Recording Requirements. Prior to the conveyance of any of the lots in <br />Discover Crossing, and except as hereinafter provided, prior to the <br />issuance of any development permits, the Developer shall provide the <br />City with evidence that the following documents have been recorded. <br />A. Plat. <br />B. A Declaration of Covenants in a form approved by the City's <br />Attorney. The Declaration of Covenants shall include the <br />following provisions: <br />Require the Homeowner Association to be responsible for <br />the Owner's obligations as contained in the appropriate <br />Conservation or Open Space Easements. <br />2. Require the Homeowner Association to maintain and <br />operate the waste water treatment system/drain field. <br />Provide that, in the event of a failure by the Homeowner <br />Association to satisfy the obligations defined in Section <br />4.07E and its subdivisions of this Development Agreement, <br />as determined by the City's Consulting Engineer, the City <br />may undertake such obligations and assess all costs <br />incurred to the Homeowner Association; and in such event, <br />the Developer for itself and for the Homeowner Association <br />hereby waives the requirements otherwise imposed by MS <br />429. <br />4. Provide that any provisions in the Covenants relating to the <br />obligations defined in Section 4.07E and its subdivisions of <br />this Development Agreement may not be repealed or <br />amended without consent of the City. <br />C. Homeowner Association Articles of Incorporation. <br />E. A Conservation Easement from the fee owners of the Open Space <br />Outlots to the Minnesota Land Trust and the City, attached and <br />incorporated as herein Exhibit D. <br />F. Valley Branch Watershed District permit. <br />4.08 Public Use Dedication. The Developer's public use dedication <br />requirement for Discover Crossing shall consist of the following: <br />A. a payment in the amount of $173,880; <br />0 <br />
