M/S/P DeLapp/Johnson — to move Home Occupations to the next Council Committee <br />meeting on April 11, 2006. (Motion passed 5-0) <br />D. Ordinance 97-167: Zoning Text Amendment — CUP in AG Zone for Outdoor <br />Social Events <br />The City Planner reported that the Planning Commission conducted a Public Hearing <br />regarding a proposal to amend the Zoning ordinance to permit "Outdoor Social Events" <br />on properties within the AG zoning district. The Commission recommends another <br />Conditional Use to the AG District for Outdoor Social Events with nine required <br />conditions. <br />Council Member Conlin expressed concerns about the noise ordinance, police and <br />parking. Residents could apply for a CUP. Council Member Smith expressed that <br />tastefully done, with adequate screening, would be acceptable. <br />Council Member Smith requested clarification of "over by 10 pm," fit, include that <br />lighting would be turned off, and everything cleaned <br />M/S/P — Johnson/Conlin — to table to the next Counerl Worksop, April 11, 2006. <br />(Motion passed 4-0-1: DeLapp-he was unable able to provide comment) <br />E. Ordinance 97-168: Amend GB Zonina District Text Restaurant Drive -Up <br />Facilities �- <br />The City Planner reported that the Planning Commission has conducted a Public Hearing <br />and recommends amendment to the G eral Business District list of "Permitted Uses" to <br />include drive -up service win*ws at cafes and restfiurants, as otherwise regulated by the <br />City Code. He noted that the tommi'ssion's r6 mmendation specifically excludes both <br />menu boards and intercom systems associated with the drive -up window. <br />I'll <br />Business owner 11 Gorman, of Gorman's Restaurant, stated that customers are changing <br />and would like to see.,a menu board approved. It would be limited to 10% or less of his <br />menu and can be placed out-of-sif fit. <br />Council Member Conlin asked if adequate vehicle stacking was a concern. City Planner <br />Dillerud said probably not for Gorman's site but would have to be reviewed on individual <br />sites. <br />City Attorney Miller explained "caf6 menu" and said it was a "slippery slope for fast <br />food." He could redraft ordinance to draw a distinction between fast food and Gorman's. <br />M/S/P DeLapp/Johnson — to bring back provisions to preclude fast-food to the April 11, <br />2006, Council Workshop, and reconsideration to the April 18, 2006, City Council <br />meeting when all members will be in attendance.
