Fake Elmo ( Agenda Section: Planning, Land Use and Zoning � No. 9B <br />City Council <br />August 2, 2006 <br />Section 520 Site Plan and Shoreland Variance — C&C North America <br />Background Information for August 2.2006: <br />On July 24, 2006 the Planning Commission unanimously adopted a recommendation for approval of a Section 520 <br />Site Plan and Shoreland setback variance for construction of a 25,200 square foot office/showroom building on a 2.04 <br />acre parcel of the Eagle Point Business Park. The building owner, C&C North America, is a distributor of Silestone <br />counter tops and flooring. The showroom section of the proposed structure will be to permit purchasers of counter <br />tops and flooring to make selections to be supplied tot heir contractors from samples on display at this facility. The <br />plan specifies that 23% of the total floor area of the proposed building will be showroom, with the balance to be <br />corporate offices for C&C North America. <br />The Planning Commission approval recommendation includes a number of design -related conditions involving <br />parking and stream bank landscape mitigation. Of those, the most significant is the substitution of "proof of parking" <br />for 15 spaces that are excess (over Code minimums), and would have been located in the OHW setback of the <br />Tributary Stream (ditch) to the west of the site. Instead of constructing those spaces, the area will be sodded, and only <br />used for future parking with City approval — which would not be unreasonably withheld. DNR concurs with this <br />strategy as well as with the structure variance and the stream bank mitigation related to proposed grading (rather than <br />very high retaining walls) in the OHW of the stream. <br />The owner's architects have provided revised drawings (staff dated July 27, 2006) that reflect the design -related <br />conditions. As such staff has removed/modified those conditions in the attached Resolution recommended for <br />adoption. <br />An additional step related to this project that is not reviewed by the Commission (per Section 400 of the Code) is the <br />final platting of Eagle Point Business Park Outlot C ( this site) as Lot 1, Block 1, Eagle Point Business Park 6 s <br />Addition. A copy of the proposed Final Plat and the Resolution approving the plat are also attached and recommended <br />for adoption. No Development Agreement is necessary since there will be no public improvements related to this plat. <br />Action items: <br />Motion to adopt Resolution #2006 - approving the Section 520 Site Plan <br />and Shoreland variance for OHW setback of a structure on Outlot C, <br />Eagle Point Business Park as recommended by the Planning <br />Commission and per plans staff dated July 27, 2006. <br />Motion to adopt Resolution #2006 - approving the Final Plat of Eagle <br />Point Business Park e Addition. <br />Attachments: Time Allocated• <br />1.
