Kimberly Anez <br />From: Travis Germundson [Travis.Germundson@dm.state.mn.us] <br />Sent: Thursday, July 13, 2006 1:52 PM <br />To: Kimberly Anez <br />Cc: Chuck Dillerud <br />Subject: C & C North America <br />DNR has reviewed the materials on the C&C North America project, located along Hudson <br />Boulevard within the shoreland district of an Unnamed Tributary to Wilmes Lake. <br />in addition to the building setback request, sections of the parking area and stormwater <br />pond would not meet the setback requirement from this tributary, and therefore would <br />require additional variances. <br />To allow grading to occur outside the property boundary is not consistent with your <br />ordinance in particular with Design Criteria for Structures and Vegetation Alteration <br />sections. The city's ordinance specifically states that Intensive vegetation clearing <br />with the shore and bluff impact zones and on steep slopes is not allowed. Steep slopes <br />appear to be present on the adjacent property. The ordinance also states that alterations <br />of topography must only be allowed if they are accessory to permitted or conditional uses <br />and do not adversely affect adjacent or nearby properties... <br />Also there are no calculations on Impervious surface coverage for this parcel. It would <br />appear based on the grading plan that almost the entire parcel would be considered <br />impervious. <br />On the basis of the information we have received, we recommend denial of the proposed <br />variance request. I do not see any demonstration of hardship to warrant granting a <br />variance for a structure setback, grading outside the property boundary, and impervious <br />surface coverage. These hardships are solely create by the property owner and are not <br />unique to the site. It would certainly appear that other reasonable and feasible <br />development designs could comply your ordinance requirements on this undeveloped parcel. <br />Thank you for the opportunity to comment on this application.
