"I'hese extra costs will be billed as time and material and a change <br />order for such will be submitted to the Owner. <br />Park Construction Company attempted to discuss this issue in good faith with the Owner before it <br />escalated to this level, but the Owner refused to do so. <br />It therefore behooves the Owner to understand the difference between disposal and stockpile and to <br />realize that any restrictions added after a project is bid and awarded are considered changes.
