MN 55807 218.629.0454 PHONE 218.628.0455 PAX July 26, 2006 City Council City of Lake Elmo 3800 Laverne Ave. Lake Elmo, MN 55042 RE: Request to be placed on the agenda for the August 2, 2006 meeting Dear Council: EBI Drilling (EBI) requests to be placed on the agenda for the upcoming August 2, 2006 meeting ofthe City Council ofLake Elmo. EBI-wishes to present to the City Council, an issue that has arisen with the Tamblyn Park/Lake Elmo heights water main proj act. EBI has been officially notified that the Stockpile Site as denoted on the plans (see attached) is not available for EBI to utilize during the course of working on the project. EBI bid the project with reference to the information contained in the Summary of Work Section 01010 Item 3 (Contractor Use of Premise) where "The contractors operation shall be confined to the areas covered in the right of way and easements granted to the owner" The Stockpile site as noted is part of the easements granted w the Owner. With no access granted to EBI to use the Stockpile Site the scope of work has significantly been altered then that contained in the Project Specifications and therefor results in a change in the contract condition. This change in condition is and will result in additional unanticipated costs. A change order for the project will be submitted to the City for approval to cover any/all increases in costs. EBI would appreciate the opportunity to address the City Council directly regarding this matter.
