B. The City wishes to acquire a permanent easement over, under and across the <br />following portion of Grantor's Property (the "Easement Area") in order to <br />construct water main improvements: <br />Insert legal description for easement <br />C. The City has obtained an appraisal of the value of the Easement Area which <br />is attached hereto; and hereby offers to acquire the Easement Area for the <br />City's appraised value, subject to the terms of this Agreement. <br />3.0 TERMS AND CONDITIONS. In consideration of the mutual undertakings herein <br />expressed, the parties agree: <br />A. Grantor Authorization/Obligations. <br />1. Grantor hereby authorizes the City, its contractors and employees to <br />enter upon the Property for the purpose of constructing the water main <br />improvement. <br />2. Grantor shall provide the City with evidence of title for the Property <br />consisting of an abstract of title, a title insurance commitment or other <br />evidence of title satisfactory to the City's attorney. <br />3. After the City has had an opportunity to review evidence of title and <br />prepare appropriate documents, the Grantor shall execute a <br />permanent water main easement in substantially the form attached as <br />Exhibit A attached (the "Grant of Easement"). <br />B. City Authorization/Obligations. <br />1. The City shall examine title as it deems appropriate and shall prepare <br />and record the Grant of Easement at its sole cost. <br />2. Upon receipt of a properly executed Grant of Easement, the City shall <br />pay Grantor the sum of $6,022.00. <br />IN WITNESS WHEREOF, the parties have executed this Agreement as of the day <br />and year set forth above. <br />CITY: <br />CITY OF LAKE ELMO <br />2 <br />Dean Johnston <br />Its: Mayor <br />
