11135.06-3 02 OFFER TO PURCHASE RIGHT OF ENTRY 1.0 PARTIES. This Agreement is dated the _ day of , 2006 and is entered into by and between the City of Lake Elmo, a Minnesota statutory city (the "City") and Richard Bergman and Eileen Bergman, husband and wife (collectively, "Grantor"). 2.0 RECITALS. A. Grantor is the record fee owner of the following described real property situated in City of Lake Elmo, County Washington, State of Minnesota (the "Property"), to wit: Section 2, Township 29, Range 21, all that part of the West 1/2 of the Northeast 1/4 of Section 2, Township 29 North, Range 21 West, Washington County, Minnesota, described as follows: Commencing at the intersection of the easterly line of said West 1/2 of the Northeast 1/4 with the southerly right of way line of Minnesota Trunk Highway Number 36 as located and traveled and monumented; thence southerly along said easterly line 760 feet to the point of beginning of the parcel being described; thence westerly and parallel with said southerly right of way line 569.35 feet; thence northerly and parallel with said easterly line 760 feet, more or less, to said southerly right of way line; thence westerly along said southerly right of way line 750.61 feet, more or less, to the westerly line of said West 1/2 of the Northeast 1/4; thence southerly along said westerly line 2454.26 feet, more or less, to the southwest corner thereof; thence easterly along the southerly line of said West 1/2 of the Northeast 1/4 1323.73 feet, more or less, to the southeast corner thereof; thence northerly along said easterly line of the West 1/2 of the Northeast 1/4 1695.95 feet, more or less, to the point of beginning.
