EXHIBIT A - DRAFT <br />DO NOT EXECUTE <br />11135.0E-3 <br />02 <br />GRANT OF PERMANENT EASEMENT <br />Richard Bergman and Eileen Bergman, husband and wife ("Grantors") represent <br />that they are the record fee owners of the following described real property situated in <br />Ramsey County, Minnesota (the "Property"), to wit: <br />Section 2, Township 29, Range 21, all that part of the West 1/2 of the <br />Northeast 1/4 of Section 2, Township 29 North, Range 21 West, Washington <br />County, Minnesota, described as follows: Commencing at the intersection of <br />the easterly line of said West 1/2 of the Northeast 1/4 with the southerly right <br />of way line of Minnesota Trunk Highway Number 36 as located and traveled <br />and monumented; thence southerly along said easterly line 760 feet to the <br />point of beginning of the parcel being described; thence westerly and parallel <br />with said southerly right of way line 569.35 feet; thence northerly and <br />parallel with said easterly line 760 feet, more or less, to said southerly right <br />of way line; thence westerly along said southerly right of way line 750.61 <br />feet, more or less, to the westerly line of said West 1/2 of the Northeast 1/4; <br />thence southerly along said westerly line 2454.26 feet, more or less, to the <br />southwest corner thereof; thence easterly along the southerly line of said <br />West 1/2 of the Northeast 1/4 1323.73 feet, more or less, to the southeast <br />corner thereof; thence northerly along said easterly line of the West 1/2 of the <br />Northeast 1/4 1695.95 feet, more or less, to the point of beginning. <br />For valuable consideration, the receipt of which is hereby acknowledged, Grantors <br />hereby convey to the City of Lake Elmo, a Minnesota statutory city, its successors and <br />assigns (the "City"), a permanent easement for the construction, maintenance, operation, <br />inspection and repair of a water main easement and public utilities; together with a <br />permanent easement for ingress and egress, at any and all times, with all machinery, tools, <br />equipment, vehicles and materials necessary for the aforesaid purposes, over, under and <br />across the following described portion of the Property: <br />Insert legal for easement <br />
