CITY OF LAKE ELMO, MINNESOTA <br />SUPPLEMENTAL AUTHORIZATION NO. 4 <br />TO: Toltz, King, Duvall, Anderson <br />and Associates, Incorporated <br />444 Cedar Street, Suite 1500 <br />St. Paul, Minnesota 55101-2140 <br />Pursuant to our Agreement dated February 2, 1988; the Authorization for the Project dated <br />February 24, 2005 (approved by the City Council on February 15, 2005); and Supplemental <br />Authorization Nos. I, 2, and 3; TKDA is hereby authorized to proceed with the following <br />additional professional services. <br />ADDITIONAL MEETINGS AND PREPARATIONS <br />NECESSARY TO DEFEND LEGAL CLAIMS FOR THE <br />NEW LAKE ELMO PUBLIC WORKS FACILITY <br />I. Add the following new paragraph to the end of SECTION I of the Authorization: <br />Leading up to and following the City's meeting with the contractor on August 18, 2006, <br />the City determined that additional meetings, meeting preparation, and follow-up work <br />would be required. The City desires TKDA to assist in preparing back-up supporting <br />documentation and preparing to serve (or serving) as an expert witness in connection with <br />possible mediation, arbitration, or legal proceedings on behalf of the City in discussions <br />with the contractor. <br />11. Add the following SECTION II.0 to the Authorization: <br />C. CONSTRUCTION PHASE <br />1. Attend meetings, and provide meeting preparation and follow-up work in <br />connection with the legal close out of construction as requested by the <br />City. <br />2. Assist in preparing back-up supporting documentation and preparing to <br />serve (or serving) as an expert witness in connection with possible <br />-mediation; arbitration,-6rTegal-proceedings on -behalf 6-f e City in - - - <br />discussions with the contractor. <br />SA4-1 <br />
