E. grading and seeding of Outlot D per plans approved by the City <br />Superintendent of Public Works and the City Engineer (credit <br />$17,690). <br />4.09 Inspection. The City shall provide the services of a Resident Project <br />Representative (and assistants as agreed) at the site to provide more <br />continuous observation of the Contractor(s) work. The Resident Project <br />Representative's dealings in matters pertaining to the on -site work shall <br />in general, be only with The City and the Developer, and dealings with <br />contractors shall only be through or with full knowledge of <br />the Developer. Through the observations of the work in progress and <br />field checks of materials and equipment by the Resident Project <br />Representative shall endeavor to provide further protection for the City <br />against defects and deficiencies in the work of the Contractor; but the <br />furnishing of such resident Project representation will not make City <br />responsible for construction means, methods, techniques, sequences or <br />procedures or for safety precautions or programs, or for the Contractor's <br />failure to perform his work in accordance with the Contract Documents. <br />The developer shall pay the City the sum of $45,000.00 for the City <br />inspection services. <br />The City shall be provided a minimum of 24 hours notice prior to the <br />commencement of underground pipe laying; and prior to subgrade, <br />gravel base, and bituminous surface construction. Developer's failure to <br />comply with the terms of this section shall permit the City Engineer to <br />issue a stop work order which may result in rejection of the work and <br />which shall obligate the Developer to take all reasonable steps, as <br />directed by the City's Engineer, to insure that the improvements are <br />constructed and inspected pursuant to the terms of this Agreement; and <br />shalt further result in the assessment of a penalty in an amount equal to <br />1%, per occurrence, of the amount of security required in Section 4.03 of <br />this Agreement. <br />4.10 Prior Land Occupancy. No Certificate of Occupancy shall be issued for <br />any homes until the first course of a public street is completed and <br />approved by the City Engineer. If homes are occupied prior to <br />completion of street improvements and acceptance by the City, <br />Developer shall provide all maintenance necessary for such streets <br />including snowplowing, until final acceptance by the City. <br />4.11 Future Lots. Outlots G, H, I, J, K, L and M, Sanctuary may be utilized as <br />future single family residential home sites upon approval of appropriate <br />changes to the City's Comprehensive Plan and zoning ordinance.
