D. Resolution No. 2005-129:Partial Payment to Tower Asphalt for Hilltop <br />Avenue <br />The City Engineer reported that Tower Asphalt has completed the 2005 Street Repairs - <br />Hilltop Avenue. The only work remaining is to make sure the grass seed comes up in the <br />spring. The City Engineer recommended approval of Partial Payment No. 2 in the <br />amount of $115,822.71. <br />M/S/P Johnson/Conlin - to approve Resolution No 2005-129, A Resolution Approving <br />Partial Payment to Tower Asphalt in the amount of $115,822.71 for work completed on <br />2005 Street Repairs -Hilltop Avenue, as verified by the City Engineer in his memo dated <br />December 1, 2005. (Motion passed 5-0). <br />E. <br />The Finance Director reported Minnesota Statute 176.001 subd;9;(5) provides that <br />"municipal officers elected or appointed for a regular term o office" are considered to be <br />employees for workers' compensation purposes only if the Lity has passed an ordinance <br />or resolution to that effect. General Fund Budget:Resolution No. 2005-132 <br />M/S/P Johnston/DeLapp resolution No. 2005-132, A Resolution Adopting the proposed <br />2006 General Fund Budget in the amount of $3,566,804.
