Berri <br />December 16, 2005 <br />Mr. Martin Rafferty <br />City Administrator <br />City of Lake Elmo <br />3800 Laverne Avenue North <br />Lake Elmo, MN 55042 <br />RE: Request for Hearing to Consider Amendments to Metropolitan System Statement <br />Dear Mr. Rafferty: <br />Pursuant to M.S. § 473.857, Subd. 1, the City of Lance Elmo ("the City") has requested a <br />hearing to consider amendments to the Metropolitan System Statement.' This is to inform you <br />that the hearing in this matter will be conducted Friday, December 30, 2005, at 2:30 p.m. The <br />hearing will be conducted by the Metropolitan Council Land Use Advisory Committee <br />("LUAC"), chaired by the undersigned. <br />The following sets out the schedule, procedures and other information for the upcoming <br />public hearing: <br />1. On or before December 23, 2005, the City shall submit to LUAC, by providing <br />copies to Ann Beckman and Charles N. Nation, attorney for LUAC, "specified proposed <br />amendments to the System Statement," as required by M.S. § 473.857, <br />2. On or before December 27, 2005, the City shall deliver to LUAC (with a copy to <br />Metropolitan Council), by providing copies to Ms. Beckman and Mr. Nauen, (1) a Prehearing <br />Memorandum identifying the issues in dispute, (2) a Witness List, (3) a list of all interested <br />persons you are aware of who may wish to testify, and (4) an Exhibit List. Please inform us if <br />you do not intend to call witnesses at the hearing. <br />1 A total of five municipalities have requested hearings.
