Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9C <br />City Council <br />July 5, 2006 <br />Agenda Item: Final Plat and Development Agreement — HOA 2nd Addition <br />Background Information for Julv, 2006: <br />United Properties has applied for Final Plat approval of the 12.6 acre Outlot A of the HOA Addition for <br />which the City Council approved a Preliminary Plat on June 20. One 4.6 acre lot of this plat will become the <br />Rasmussen Business College site. No Planning Commission review of Final Plats and Development <br />Agreements is required by the City Code. <br />The draft Development Agreement has been prepared by staff and is attached. This DA differs in content to <br />some degree since we are addressing a non-residential property to which earlier Eagle Point DA's still apply <br />(as to Public Use Dedication, Covenants and Declarations). Also TKDA has been retained by United <br />(through a City contract) to design all plat infrastructure, and the City Engineer has opted to not require line <br />item specific cost estimates for infrastructure improvements in the DA — simply a total "Street and Utilities" <br />estimates. <br />Person res ible• <br />Action items: <br />Cit P t er -) <br />Motion to adopt Resolution #2006 - approving the Final Plat and <br />Development Agreement of the HOA 2nd Addition. <br />Attachments: <br />Time Allocated: <br />1.
