Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9C <br />City Council <br />June 20, 2006 <br />Agenda Item: Preliminary Plat of HOA 2"d Addition and Site Plan for Rasmussen Business College <br />Background Information for June 20, 2006: <br />At its meeting June 12, 2006 the Planning Commission conducted a Public Hearing and unanimously <br />adopted a recommendation to approve the Preliminary Plat of the HOA 2"d Addition. The Commission also <br />reviewed and unanimously recommended approval of the Section 520 Site for a 20,500 square foot <br />Rasmussen Business College — to be located on a 4.11 acre HOA 2"d Addition lot. The applicant (United <br />Properties) agreed on the Record to modify the site plan to mitigate the City Code/Zoning Ordinance non- <br />compliance matters raised by the Planning Staff Report. No variances have been applied for nor will be <br />required, but the conditions are carried forward into the Site Plan approval Resolution. <br />One semi non-compliance matter raised by the Planning Staff report is the proposal by United to install <br />street lighting in the median and along the short cul-de-sac street of the HOA 2"d Addition. Staff has <br />suggested that street lighting (except at designated street intersections) is generally contrary to City strategy <br />— Dark Sky. Staff has advised both the applicant and the Planning Commission that a specific City Council <br />waiver of the street lighting strategy will be required to permit the street lights proposed. The Commission <br />did discuss and adopt a recommendation on the street light issue. That recommendation is to allow the street <br />lights to be installed design -compliant with the City's lighting ordinance and at the developer's sole <br />expense, subject to a provision that the lights be extinguished between 11:00 PM and 5:00 AM. <br />Action items: C . 1 <br />1. Motion to adopt Resolution #2007 — approving the Section 520 <br />Site plan for Rasmussen College based on the recommendation of <br />the Planning Commission per plans staff dated June 12, 2006 as <br />modified by the conditions of approval. <br />3. Motion to approve street lighting of Eagle Point Circle per <br />plans staff dated Junbe 12, 2006 on the conditions that the lighting <br />be compliant with City Code standards and that the lighting be <br />extinguished between 11:00 PM and 5:00 AM. <br />Attachments: e ! 4 <br />Time Allocated: <br />1.
