Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9A <br />City Council <br />March 21, 2006 <br />$I6d <br />Agenda Item: Request for Reconsideration — Haire Variance (Hill Trail) <br />Background Information for March 21, 2006: <br />Staff has been contacted by the applicants for this variance to OHW setback and minimum lot area that was <br />denied by the City Council on March 6, 2006. They have advised that they were unaware of the changed <br />Council meeting date (from regular Tuesdays to the March 6 Monday due to caucus) until it was too late to <br />attend and present their application. Staff confirms that neither applicant was in attendance at the March 6, <br />meeting. An agenda/notice of the meeting was mailed to Mr. Haire by the City Clerk, but Mr. Haire advises <br />that he did not notice the date change from what had been announced at the prior Planning Commission <br />meeting. He also advises that he was prepared to present additional information that would address some of <br />the concerns stated in the findings for variance denial. <br />Considering the somewhat unique circumstances of this situation staff has agreed to poll the Council as to <br />whether there is interest by the Council to move reconsideration of the application at a later Council <br />meeting — probably April 4. Since the four Council Members in attendance on March 6 all voted for the <br />Resolution to deny, any of those four may offer a Motion to reconsider — per advice from Attorney Filla. <br />The applicants have agreed to extend the 60 day application review period should the Council decide to <br />reconsider. <br />Person responsible: <br />Action items: <br />Motion to reconsider the Haire variance application at the April 4, <br />Ci e <br />2006 City Council Meeting to enable the applicants to present <br />additional information regarding the application. <br />In the alternative the Council could take no further action and the <br />application will remain concluded as a denial. <br />Attachments: <br />Time Allocated: <br />
