Lake Elmo Agenda Section: Planning, Land Use and Zoning No. 9E <br />City Council <br />March 21, 2006 <br />Agenda Item: Amend GB Zoning District Text Restaurant Drive-Un Facilities <br />Background Information for March 21, 2006: <br />On March 13, 2006 the Planning Commission conducted a Public Hearing to consider an amendment to the <br />GB zoning district to permit drive -up service windows in restaurants/cafes. This proposed zoning text <br />amendment was proposed by staff following denial of a building permit to Gorman's restaurant for <br />construction of such a facility based on lack of specific Zoning Ordinance use authority. The Commission <br />discussed the amendment at multiple meetings with the primary issue being whether or not such a drive -up <br />facility should be permitted to include a remote menu board and intercom ordering equipment. The <br />conclusion of the Commission was that the menu board/intercom features would not be in the public interest <br />and should be prohibited. <br />Another concern of the Commission was whether the drive -up feature would open the door for typical fast <br />food restaurants. The Commission concluded that the very specific definition of "Restaurant" found in <br />Section 150 of the City Code essentially precludes fast food restaurants. The prohibition of menu <br />boards/intercoms appears to further limit the probability that a typical fast food restaurant could be <br />accommodated by the Zoning Ordinance. <br />The attached draft ordinance adds Drive -up windows for restaurants as an additional Permitted Use in the <br />GB zoning district subject to the menu board/intercom prohibition — as recommended by the Commission. <br />Action items: <br />►W <br />Motion to adopt Ordinance #97 — amending the text of Section <br />300 of the City Code (Zoning Ordinance) to add drive -up <br />windows as a Permitted Use for restaurants in the GB zoning <br />district. <br />Attachments: 16s <br />1.
