4.05 Administrative Fees. Developer agrees to pay an administrative fee to <br />the City in an amount equal to 2.5% of the Developer's secured <br />improvements. The administrative fee for this project equals $20,157. <br />4.06 Utility Company Improvements. The utility improvements include <br />underground gas, electric, and telephone service as installed by the <br />appropriate utility company at the direction of the Developer. The <br />Developer shall arrange for the installation of underground gas, electric, <br />telephone and cable television before the final lift is started. Utility <br />improvements shall be completed by the 30th day of November, 2007. <br />4.07 Recording Requirements. Prior to the issuance of any occupancy permits <br />for Lot 1, Block 1 of the Subdivision, the Developer shall provide the City <br />with evidence that the following documents have been recorded. <br />A. Plat for the Subdivision. <br />B. Valley Branch Watershed District permit. <br />4.08 Public Use Dedication. No Public Use Dedication shall be required for <br />the Subdivision. <br />4.09 Inspection. The City shall provide the services of a Resident Project <br />Representative (and assistant as agreed) at the site to provide more <br />continuous observation of the Contractor(s) work on publicly dedicated <br />infrastructure and private wastewater treatment systems/drain fields. <br />The Resident Project Representative's dealings in matters pertaining to <br />the on -site work shall, in general, be only with the City and the <br />Developer, and dealings with Contractors shall only be through or with <br />full knowledge of the Developer. Through the observations of the work <br />in progress and field checks of materials and equipment by the Resident <br />Project Representative shall endeavor to provide further protection for <br />the City against defects and deficiencies in the work of the Contractor(s) <br />but the furnishing of such resident project representation will not make <br />City responsible for construction means, methods, techniques, <br />sequences or procedures for safety precautions or programs, or for the <br />Contractor's failure to perform his work in accordance with the Contract <br />Documents. The Developer shall pay the City the sum of $24,000 for the <br />City inspection services. <br />4.10 Prior Land Occupancy. No Certificate of Occupancy shall be issued for <br />any structure until the first course of a public street is completed and <br />approved by the City Engineer, and the developer has provided the City <br />a certified "as built" of the mass grading of the site which complies with <br />the approved grading plan.
