9. <br />A. "The Sanctuarv" — OP Development Stage Plan/CUP/Preliminary Plnt — <br />Resolution No. 2005-106 <br />The City Planner reported this is an OP application to divide 153 acres into a maximum <br />of 62 single family detached building lots, and 76 acres of Preserved Open Space. <br />Based on the current zoning ordinance, 55 lots would be final platted and 7 potential lots <br />would appear as outlots pending an anticipated future amendment to the zoning ordinance <br />increasing OP density from 0.40 units/acre to 0.45 units per acre. The Preserved Open <br />Space proposed responds in an area to the ultimate 62 lot configuration. One proposed <br />lot (of either the 55 or 62) is proposed in return for restoration of the historic dairy barn <br />by expenditure of at least $25,000, The OP Final Plan will be required to include specific <br />plans and cost estimated for that barn restoration. <br />The Planning Commission did not agree with the City Engineer's suggestions for two <br />roundabout intersections or 26 foot wide street sections (except where the north/south <br />street must meet MSA design standards), but does concur with the balance of the City <br />Engineer's recommendations. <br />The Park Commission concurred with the applicant's proposal to adjust the location of <br />the public trail link from the south property line to the center open space outlet. They did <br />not fully concur with the applicant's proposal that the applicant construct some features <br />within the partial City Park that would be dedicated with the plat as credit toward Park <br />Dedication Fees. The Park Superintendent was asked to review the future City park site <br />to determine what improvements the developer could make during his construction <br />phase -perhaps grading —that could be Park Dedication credit but not result in <br />automatically placing this partial park site ahead of other necessary park/trail <br />improvements elsewhere in the City. <br />There was Council concurrence on the lots designated in red on the copy of the <br />preliminary plat that has been signed by the Planner shall not be developed unless the <br />City changes its regulations to permit a greater density, and if the City does not permit a <br />greater density, those lots will become land trust conservation easements or open space <br />easements. <br />There was Council concurrence that Lots 1-7, Block 2, shall be reduced in lot depth, and <br />Outlot B increased in area to preclude private property ownership of any portion of MN <br />DNR protected Wetland 482-316W or the 15 foot vegetative buffer to the wetland <br />required by the VBWD. <br />There was Council concurrence that the OP Final Plan submission shall include <br />construction detail and costs estimate for the restoration of the historic barn site <br />M/S/P Smith/Conlin — to adopt Resolution No. 2005-106, A Resolution Approving the <br />OP Development Stage Plan Conditional Use Permit, and Preliminary Plat of The <br />Sanctuary -including -the eight conditions stated in the Resolution.
