Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9B <br />City Council <br />November 21, <br />2006 <br />Agenda Item: Final Plat — Farms of Lake Elmo 2°d Addition <br />Background Information for November 21.2006: <br />The 2005 approval of the PUD Preliminary and Final Plans/Plats of Farms included three outlots designed <br />as building lots that could be re -platted as legal lots in the future responsive to then -contemplated <br />amendments to the Comprehensive Plan that would increase the maximum allowable OP density to 18 per <br />40 acres from 16 per 40 acres. By July, 2006 that Comprehensive Plan to increase OP density to 18 units <br />per 40 acres was approved by both the City and the Metropolitan Council. While the City continues to work <br />toward amending its zoning ordinance text to include that change, whenever a Comp Plan and Zoning <br />ordinance conflict (as they do in this regard today), the Comprehensive Plan prevails. Therefore, the outlots <br />are eligible for final platting into building lots. <br />The attached Resolution is for approval of the outlot/building lot conversion by Final Plat.
