Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9C <br />City Council <br />November 21, <br />2006 <br />Agenda Item: Final Plat — St. Croix's Sanctuary 2"d Addition <br />Background Information for November 21. 2006: <br />The 2005 approval of the PUD Preliminary and Final Plans/Plats of Sanctuary included seven outlots <br />designed as building lots that could be re. -platted as legal lots in the future responsive to then - <br />contemplated amendments to the Comprehensive Plan that would increase the maximum allowable OP <br />density to 18 per 40 acres from 16 per 40 acres. By July, 2006 that Comprehensive Plan to increase OP <br />density to 18 units per 40 acres was approved by both the City and the Metropolitan Council. While the City <br />continues to work toward amending its zoning ordinance text to include that change, whenever a Comp Plan <br />and Zoning ordinance conflict (as they do in this regard today), the Comprehensive Plan prevails. <br />Therefore, the seven outlots are eligible for final platting into building lots. <br />The attached Resolution is for approval of the outlot/building lot conversion by Final Plat.
