Lake Elmo <br />Agenda Section: Planning, Land Use & Zoning <br />No. 9A <br />City Council <br />November 8, <br />2006 <br />A ends Item: Gars a Location Waiver— Dean Otteson, 11989 30t' St. N. <br />Background Information for November 8, 2006: <br />The property owner has applied for a Waiver by Resolution to locate a 40 foot by 28 foot garage structure <br />nearer the front lot line than the principal structure (house) on the lot. The garage structure would be <br />located approximately 180 feet from the north property line (front). The proposed garage would be situated <br />north east of the house. <br />On the lot are two existing accessory structures which are planned for removal. One of the two existing <br />accessory structures is currently nearer the front lot line than the principal structure. This structure is <br />proposed to be removed and replaced by the proposed structure further from the front lot line. The existing <br />structure is approximately 140 feet from the front property line. <br />Section 300.13, Subd. 3C of the City Code provides that the Council must approve any application to <br />construct a detached garage in the R-R District that would be neared the front property line than the <br />principal structure. <br />Due to the substantial set back of the proposed garage from the front property line and its replacement of a <br />garage currently closer to the north property line, staff recommends adoption of the attached Resolution <br />a proving the garage location. <br />Person responsible: <br />Action items: <br />City Planner <br />Motion to adopt Resolution 2006 - 120, approving the location of <br />Assistant Planner <br />a 40 foot by 28 foot detached garage nearer the front property line <br />than the principal structure at 11989 30`h St. N., per plans staff - <br />dated October 13, 2006. <br />Attachments: <br />Time Allocated: <br />1.
