CITY OF LAKE ELMO <br />DAVID HARDY AND LINDA HARDY <br />SITE DEVELOPMENT AGREEMENT <br />1.0 Parties. This Agreement is dated the _ day of 2006, and is <br />entered into by and between the City of Lake Elmo, a Minnesota statutory city <br />("City"); and David Hardy and Linda Hardy (collectively "Hardy"). <br />2.0 Recitals. <br />A. Hardy is the record fee owner of the property located at 9224 31 s` Street <br />North and legally described as follows: <br />dated October 10, 2005. <br />THAT PART OF THE SOUTHWEST QUARTER OF SECTION 15, <br />TOWNSHIP 29, RANGE 21, WASHINGTON COUNTY, MINNESOTA <br />DESCRIBED AS FOLLOWS: <br />COMMENCING AT THE SOUTHWEST CORNER OF <br />SAID SECTION 15; THENCE NORTH ALONG THE WEST <br />LINE OF SAID SOUTHWEST QUARTER, 445.2 FEET TO THE <br />POINT OF INTERSECTION WITH THE CENTERLINE OF 31ST <br />STREET NORTH (ALSO KNOWN AS OLD STILLWATER <br />AND ST. PAUL ROAD); THENCE EASTERLY ALONG SAID <br />CENTERLINE OF SAID ROAD, 1228.9 FEET TO THE POINT <br />OF BEGINNING; THENCE NORTH AND PARALLEL BY 1175 <br />FEET WITH SAID WEST LINE OF SAID SECTION 15, A <br />DISTANCE OF 187.4 FEET TO THE SOUTH RIGHT-OF-WAY <br />LINE OF CHICAGO AND NORTHWESTERN (ALSO KNOWN <br />AS C. ST.P. MPLS. & O.) RAILWAY COMPANY; THENCE <br />WESTERLY ALONG SAID RIGHT-OF-WAY LINE 105.4 <br />FEET; THENCE SOUTH AND PARALLEL BY 1070 FEET <br />WITH SAID WEST LINE OF SAID SECTION 15, TO THE <br />POINT OF INTERSECTION WITH THE CENTERLINE OF 315T <br />STREET NORTH (ALSO KNOWN AS OLD STILLWATER <br />AND ST. PAUL ROAD); THENCE EASTERLY ALONG SAID <br />CENTERLINE TO THE POINT OF BEGINNING. ("Hardv <br />Property"). <br />B. On the I" day of November, 2005, the City approved Resolution 2005-118 <br />which allowed Hardy to move a single-family detached building <br />("Building") onto the Hardy Property. <br />
