1. This matter can be placed on the next City Council Agenda for a <br />determination by the City Council that the condition of the property <br />constitutes a public nuisance affecting safety (attractive danger and <br />hazardous building). After the City Council makes this determination, a <br />copy of the Resolution and an appropriate letter should be sent to the <br />property owner. If the offending condition is not corrected within five days, <br />the City should take whatever steps are necessary to make the property <br />safe and commence a civil action against the property owner to recover <br />the costs or, in the alternative, specially assess the costs against the <br />property pursuant to Lake Elmo Code Section 1335.13. <br />1. Notify the Lake Elmo Bank that the unsafe condition exists and that <br />the City will be submitting a draw request on November 2, 2006, if the <br />terms of the City Council Resolution 2005-118 are not satisfied by <br />November 1, 2006. If the City collects on the Letter of Credit, it can then <br />let a construction contract to complete the required improvements and <br />recover the costs from the proceeds of the Letter of Credit. <br />Please send me a copy of any Improvement Plans for the site.
