Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9L._ <br />City Council <br />October 3, 2006 <br />Agenda Item: Fly Ash Land Fill Siting <br />Background Information for October 3, 2006: <br />As we previously advised the Council, MPCA conducted a Scoping Environmental Assessment Worksheet <br />(SEAW) Public Meeting regarding the proposed Xcel Fly Ash land fill in West Lakeland Township at Oak - <br />Land school on September 21. The meeting was well attended (auditorium nearly full), including our local <br />State legislators. As I expected. and as I am certain has happened at these EAW Scoping meetings in the <br />past, the legal and intended purpose of the meeting was misunderstood by most attendees. This meeting was <br />not to hear testimony regarding the West Lakeland site proposal, but merely to inform the Public of the <br />Environmental Impact Study process and inform the Public that they are invited to submit written <br />suggestions as to what additional subjects (beyond those already addressed in the draft SEAW) during the <br />45 day SEAW review & comment period (ending October 12). MPCA staff would not respond to any <br />comments regarding the project except to explain (repeatedly) that this was not the forum for those <br />comments. <br />The only matter raised by the Public that MPCA staff took note of and agreed to look into was a further <br />extension of the SEAW comment period (to beyond 45 days — which was already a requested extension <br />from the normal 30 days). Beyond that, the 2 hour meeting was of little value — to the attending Public or <br />MPCA — and merely a procedural pro forma. <br />Lake Elmo staff continues to review the draft SEAW and intends to submit comments by either the current <br />October 12 deadline or whatever extended comment period that may be provided by MPCA. <br />Action items: <br />Person re nsible• <br />C ty <br />None Required <br />Attachments: <br />Time Allocated: <br />None <br />
