Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9D <br />City Council <br />October 3, 2006 <br />Agenda Item: Re-Establish/Modify OP Development — Amend AG, RR & OP <br />Background Information for October 3, 2006: <br />On September 11, 2006 the Planning Commission conducted a Public Hearing and thereafter unanimously <br />adopted a recommendation to amend the AG, RR, and OP district text of the zoning ordinance to both re- <br />establish OP development as a Conditional Use in AG and RR, and increase the allowable density for OP <br />from 16 units per 40 acres (0.40 units per acre) to 18 units per 40 acres (0.45 units per acre). The AG & RR <br />districts were amended in 2005 to remove the OP option (as a CUP) pending completion of the <br />Comprehensive Plan. <br />With the land south of 10'' now precluded from OP development by the FSD land use classification (and, <br />soon, corresponding zoning), and the Village Area zoning to be held in abeyance by the development <br />moratorium appearing as Item 9E on this agenda, there is no continuing need to withhold OP development <br />within the remaining RAD guided areas of the City. In addition, the 2030 Comprehensive Plan increases <br />the maximum allowable RAD development density using OP from .040 units per acre to .045 units per acre <br />(16 units per 40 increased to 18 units per 40).
