Lake Elmo <br />Agenda Section: Planning, Land Use and Zoning <br />No. 9C-r <br />City Council <br />October 3, 2006 <br />Agenda Item: Development Moratorium — Village Area <br />Background Information for October 3, 2006: <br />The Village Area remains an open issue as to detailed land use as of now. The City Attorney advises, <br />however, that we may now adopt a new Development Moratorium for the Village Area pending completion <br />of the detailed plan for that area that has now been contracted for. "Protection" of the Village Area from <br />premature and inappropriate development can be assured even with the OP ordinance again operative. A <br />Moratorium Ordinance covering the Village Area is attached for Council consideration. <br />The length of the moratorium is not specified — and should be along with any motion to adopt the ordinance. <br />Staff recommends a minimum of 6 months (180 days) through March, 2007. We expect Village Area <br />planning to be completed by that time. Village Area property owners will need to be submitting applications <br />responsive to the Village Area Plan by March if development is contemplated during 2007. Should projects <br />clearly consistent with the spirit and intent of the planning require earlier action, the ordinance provides for <br />early removal of those properties. <br />Action items:ON-1 <br />Person res onsible: <br />Motion to adopt Ordinance #97 = adopting a Development <br />Moratorium for the Village Area now subject to contractual and <br />land use planning and design by the City. <br />Attachments: <br />Time Allocated: <br />1.
