Lake Elmo Agenda Section: Planning, Land Use and Zoning No. 9E <br />City Council <br />September 5, <br />2006 <br />— Xcel Fly Ash Land Fill <br />Background Information for September 5, 2006: <br />Following the disbanding of the Xcel "Citizen's Advisory Committee" on King ash land fill siting in 2005 <br />Xcel returned focus to their original site of choice (which they hoped the Committee would endorse — but <br />they didn't) in West Lakeland Township. They (Xcel) had announced much earlier that they would prepare <br />a "voluntary" Environmental Impact Statement (EIS) for whatever site they ended up focusing on. That <br />process has now started. State EQB Rules designate the Minnesota Pollution Control Agency (MPCA ) as <br />the "Responsible Governmental Agency" for this type of project — probably since MPCA would be the <br />primary State permitting agency. MPCA was well represented at the Citizen's Committee meetings in 2005, <br />and repeatedly endorsed the land fill technical methodology that Xcel proposes as the best solution for King <br />plant ash disposal. <br />The initial step in the EIS is preparation of a Scoping Environmental Assessment Worksheet (SEAW). This <br />is done by the Responsible Governmental Agency (MPCA in this case) — usually using consulting services <br />paid for by the project sponsor (Xcel in this case). The SEAW is solely intended to address the scope of the <br />forthcoming EIS — what should be addressed in the EIS document to fully asses the impacts from, and <br />alternatives to, the proposed project. The SEAW was issued on August 28, and the public comment period <br />on the SEAW will run for 45 days. Copies of the SEAW are in the Council's mail box. Lake Elmo Staff has <br />not had time to look over the SEAW in detail yet.
