Mayor Hunt indicated the concept plan seems to appear to alter the wetlands. <br />There is a concern on the extension of road to adjacent property. The <br />Appendage on the east is irrelevant to the cluster development and is not <br />integrated within the development. <br />M/S/P Dunn/DeLapp - to table and ask City staff to prepare resolution for <br />denial for Council consideration based on comments at the meeting. (Motion <br />passed 4-1 Siedow stated with the inclusion of the 3 conditions this concept <br />plan meets the letter of the OP Ordinance.) <br />H. Extend Zoning Variance Review — Patrick Kinney <br />Planner Dillerud reported that Mr. Kinney requested that April 22 Planning <br />Commission consideration of the matter be deferred by his April 19, 2002 E- <br />Mail. The next available Planning Commission meeting at which this <br />application can be considered is May 13; and that will result in City Council <br />consideration no earlier than May 21. The Council was requested to extend <br />the review period for the Kinney application 60 days — to July 18, as <br />permitted by State Statute. <br />M/S/P DeLapp/Armstrong — to extend the City review period for the Kinney <br />Zoning Variance application 60 days to July 18, 2002. (Motion passed 4-0 <br />Council member Dunn had stepped out of the meeting during the vote.) <br />I. Escrow Reduction —Eagle Point Business Park 2"d Addition <br />City Engineer Prew reported United Properties has completed most of the 2"d <br />Addition public improvements under the Development Agreement covering <br />those improvements. In his memo dated April 26, 2002, the City Engineer <br />described the work completed and remaining; and, escrow reduction <br />accordingly. <br />M/S/P Siedow/DeLapp — to approve reduction of the escrow for Eagle Point <br />Business Park 2nd Addition from $800,000 to $250,000, as recommended by <br />the City Engineer. (Motion passed 4-0 Council member Dunn had stepped <br />out of the meeting during the vote.) <br />J. Final Plat — Eagle Point Town Office Park <br />Planner Dillerud reported the Planning Commission recommended approval <br />of the Preliminary Plat of Eagle Point Town Office Park. This plat is to <br />further divide Lot 1, Block 1 of the Eagle Point Business Park 2na Addition to <br />create 24 individual condo offices and a common lot service area for all <br />owners. The Final Plat differs from the preliminary only, to the extent that a <br />4 foot "jog" has been added in lots 18-24 to overcome a "slab" appearance to <br />the north wall of the structure. City Attorney Filla advised that since no <br />public improvements are being constructed, no Development Agreement will <br />be necessary. The access easement to the City from Eagle Point Blvd. to the <br />future well site has been prepared by the City Attorney, but must be recorded <br />after the Final Plat is recorded. <br />LAKE ELMO CITY COUNCIL MINUTES MAY 7, 2002 10 <br />
