Mayor Hunt stated he was not certain the rezoning from GB to LB was even going to <br />happen because this land has been zoned GB for a long time. He said the developer has <br />been working on this plat in good faith, and the Council needs to deal with the plat that is <br />before them. <br />M/S/F DeLapp/Armstrong — to table this application for preliminary plat approval. <br />(Motion failed 2-3 Siedow, Dunn, Hunt.) <br />Council member DeLapp indicated in the LB zoning the intensity would be less with <br />higher quality and did not like to have a commercial development this intense so far from <br />downtown. <br />Council member Armstrong stated she would like to see larger buildings rather than <br />many small buildings built there. Tim Freeman said it is possible to have a larger use, <br />but this would depend on the market. Mr. Regan stated in the marketplace this plat does <br />not have sewer and water service, which is a major affect in the intensity and on the <br />marketplace. <br />M/S/F Siedow/Hunt - to adopt Resolution No 2002-105, A Resolution Approving the <br />Preliminary Plat of Lake Elmo Business Park. (Motion Failed 2-3 Dunn, Armstrong, <br />DeLapp) <br />Council member Dunn wanted to know exactly what the delineation of uses between LB <br />and GB uses. She said she was very uncomfortable when you're talking big box retail. <br />Mr. Regan stated he observed Council member Dunn's vote as "yes" for this motion on <br />approval of the Preliminary Plat. Mayor Hunt apologized he did not clarify the results of <br />the motion, but he did hear Council member Dunn vote on the negative side. <br />Katie Nath, part-owner of this parcel and a resident of Lake Elmo, observed Council <br />member Dunn voting "aye" along with Council member Siedow and Mayor Hunt. She <br />asked that the differentiation between uses in LB and GB be presented if this is Council <br />member Dunn's issue. <br />Mr. Regan stated they would put up a sign on the property and respond to the market, but <br />would be responsive to the City's zoning codes and plat guidelines. <br />M/S Armstrong/DeLapp - to table this application for approval of the Preliminary Plat of <br />the Lake Elmo Business Park. Attorney Filla pointed out this motion cannot be made by <br />Council member Armstrong because she was not on the prevailing side of the motion. <br />M/S/P Dunn/Siedow - to reconsider the motion to approve the Preliminary Plat.
