R-73-30 <br />RESOLUTION <br />VILLAGE OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION REJECTING ALL BIDS FOR IMPROVEMENT PROJECT <br />1973-2(1-94 UTILITY CROSSINGS). <br />WHEREAS, the State of Minnesota through its Highway Department <br />has stopped the planned construction of Interstate Highway No. 94; <br />and <br />WHEREAS, there appears to be a possibility that those plans <br />could be changed with respect to location of the highway; and <br />WHEREAS, the Village Council ordered Public Improvement <br />Project 1973-2 (1-94 Utility Crossings) for the purpose of installing <br />utility crossings under the proposed Interstate Highway No. 94 <br />during the course of its construction so as to reduce the ultimate <br />cost of installing such facilities in the Village; and <br />WHEREAS, appropriate Village officers had not entered into a <br />contract for the construction of said utility crossings at the time <br />the State stopped the planned construction of Interstate Highway <br />No. 94: <br />NOW, THEREFORE, BE 1T RESOLVED by the Village Council of the <br />Village of Lake Elmo: <br />1. That the prior resolution of the Village Council accepting <br />the bid of A. J. Chromy Construction Company for the construction <br />of said utility crossings be, and the same is hereby rescinded. <br />2. The Village Council hereby determines that it would be <br />impossible to construct said utility crossings at the present time <br />since the location of Interstate Highway No. 94, if in fact it is <br />to be constructed in the future, cannot be determined with certainty <br />at this time and as a result it is necessary, advisable, and in <br />the public interest to reject all bids received in connection with <br />said Public Improvement 1973-2 (I-94 Utility Crossings); the same <br />are, accordingly, hereby rejected. <br />3. The Village Clerk is hereby authorized and directed to <br />return forthwith to all bidders the deposit made with their bids. <br />4.
