R-73-36 RESOLUTION VILLAGE OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION DECLARING COST TO BE ASSESSED AND ADOPTING THE ASSESSMENT FOR THE 1972 WATER MAIN EXTENSION PROJECT. WHEREAS, contract has been read for the improvement described as the 1972 Water Main Extension and the total cost of said improvement has been determined to be $; all of which is to be assessed to the benefited property by reason of the agreement of the owners of the porperty to be assessed; and WHEREAS, the agreement of the said property owners as incorporated in resolution are--72-18 of the Village of Lake Elmo and consented to by said owners in writing by endorsement of said resolution in file with the Village Clerk, provides that the assessment for said improvement shall be on the basis of the benefit to land owned by them as determined by the Village Council; and WHEREAS, the Village Council has accordingly directed the Village Clerk, with the assistance of the Village Engineer to calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land benefited thereby, without regard to cash valuation, as provided by law; and said proposed assessment having been prepared and presented to the Council here with: NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of Lake Elmo:. 1. Such proposed assessment, copy of which is attached here to and made a part here of, is hereby excepted and shall constitute the special assessment again the lands name therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 20 years, the first installment to be payable on or before the first Monday in January 1974 and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution to the first installment shall be added interest on the entire assessment from the date of this resolution until December 31st, 1973. To each subsequent installment when due shall be added interest for one year on all unpaid installments.
