IT IS FURTHER RESOLVED that the within variance is <br />granted in spite of the apparent violation of the East <br />Oakdale Subdivision Ordinance effective at the time, for <br />the specific reason (and based on the specific determination <br />by this Council) that the applicants had no actual <br />knowledge of the violation at the time of the purchase; <br />that the applicants had no actual knowledge of that <br />violation until sometime during the year 1973 when they <br />made application for a building permit and that the <br />applicants would in all probability be unable to rescind <br />the sale contract or otherwise recover against the seller <br />because the sale transaction is so remote in time that <br />judicial proof will be difficult to secure. <br />Adopted by the Village Council that this 4th day of <br />December, 1973. <br />Calvin J.
