R-75-21 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION ORDERING EMERGENCY FLOOD CONTROL PROCEDURES. <br />WHEREAS, the Lake Elmo City Council has determined on the <br />report of numerous citizens and the investigation of the City <br />Engineer that an imminent threat of substantial flood damage exists <br />because of unusually heavy rains, that such flood damage would result <br />not only in loss of property but also in potential health hazards due <br />to flood related pollution of surface water. Said Council has further <br />determined that such circumstances constitute a public emergency, and <br />WHEREAS, the City Council has heretofore directed its Engineer <br />to prepare a written preliminary report on the cost and feasibility of <br />certain temporary and long range surface water control improvements to <br />be made pursuant to the provision of Chapter 429 of the Minnesota <br />Statutes, and <br />WHEREAS, it appears that before undertaking such a project certain <br />emergency procedures should be carried out in order to prevent immediate <br />flood damage; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council that the City <br />Engineer and other City officers and employees are hereby empowered <br />to proceed immediately with the following emergency procedures in order <br />to prevent loss of property and pollution hazards: <br />1. Emergency pumping from Deer Pond to Hedges Pond or other suitable <br />disposal area and emergency pumping to other area where, in the determination <br />of the City Engineer, such pumping is necessary to prevent flood damage <br />or health hazards which may be caused by flooding. Said emergency <br />pumping to be carried out through the use of available pumps with necessary <br />piping, equipment, fuel and labor. Provided, said pumping shall be <br />carried out only as needed in the opinion of the City Engineer to prevent <br />flood damage or health hazards which May be caused by flooding. <br />2. A temporary dam in the Demontreville Highlands area to hold back <br />and store threatening water to the extent the City Engineer deems <br />reasonable and practical to prevent flood damage or health hazards <br />which may be caused by flooding. <br />BE IT FURTHER RESOLVED, said emergency procedures, including pumping, <br />shall be carried out as provided herein from the date hereof through <br />July 15, 1975, but no longer, and the costs incurred in carrying out such <br />emergency procedures shall not exceed the sum of $5,000.00 without further <br />order of the City Council. <br />
