R-75-3 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION RELATING TO INSTALLATION OF COIN - <br />OPERATED AMUSEMENT MACHINES AT WHITE HAT RESTAURANT <br />WHEREAS, Conrad Adams as owner and manager has made application for permit <br />to install coin -operated amusement machines in the White Hat Restaurant located <br />at 11011 North Stillwater Blvd., Lake Elmo, Minnesota; and <br />WHEREAS, a Special Use Permit is required for the operation of commercial - <br />recreational facilities; and <br />WHEREAS, this Council has determined that the installation of the proposed <br />machines may constitute a commercial -recreational use if it substantially changes <br />the nature of the restaurant use now being carried at said location: <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby authorizes the <br />Clerk to issue a license for the installation of coin -operated amusement machines <br />at the White Hat Restaurant but reserves the right to suspend the operation of <br />such machines on such premises and require the owner or operator to apply for a <br />Special Use Permit if the installation of said machines substantially altersthe <br />present existing restaurant use so as to result in a commercial -recreational use <br />being maintained on said premises. <br />BE IT FURTHER RESOLVED, that acceptance of the license and installation of <br />coin -operated amusement machines on said premises by said owner constitutes a <br />consent to the conditions of this Resolution and an agreement to apply for a <br />Special Use Permit and be bound by the decision of this Council in the event this <br />Council determines a Special Use Permit for the operation of a commercial -recreational <br />facility should be required to continue the operation of said coin --operated amuse- <br />ment machines. <br />Adopted by the City Council this 21st day of January, 1975. <br />Attest: <br />Donald Mehsakomer, Clerk <br />Maynard,tder, Mayor <br />
