R-76- 1 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION RECEIVING ENGINEER'S PRELIMINARY REPORT AND <br />CALLING FOR A PUBLIC HEARING ON SURFACE WATER CONTROL <br />PROJECT II (1976 ) <br />WHEREAS, the City Council of the City of Lake Elmo has received and reviewed <br />various reports prepared by its City Engineer with respect to the proposed improve- <br />ments for the control of surface water and the prevention of flooding in the City <br />of Lake Elmo which reports include said Engineer's cost estimates and recommenda- <br />tions with respect to the feasibility of said project, <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo: <br />1. That the Council will consider the said improvements, as more particubrly <br />described in the Notice of Public Hearing annexed hereto and made a part hereof as <br />Exhibit "A", in accordance with said reports of the City Engineer, and will further <br />consider the assessment of benefited property for all or a portion of the cost of <br />the improvements pursuant to the provisions of Chapter 429 of the Minnesota <br />Statutes. The total estimated cost of the improvement is $38,000.00. <br />2. A public hearing will be held on the proposed improvement on the 20th <br />day of April, 1976, at 8:00 o'clock p.m. in the City Hall of the City of Lake <br />Elmo; the City Clerk shall give mailed and published notice of such hearing, <br />in substantially the form annexed hereto as Exhibit "A", as required by law. <br />BE IT FURTHER RESOLVED, that a copy of said Notice be directed to the <br />Valley Branch Watershed District and the Department of Natural Resources <br />together with a letter notifying both of those agencies that the City of <br />Lake Elmo intends promptly on receipt of permits if it is determined that <br />an emergency then exists, to proceed with the pumping of Lake Jane to the <br />extent that the City Engineer determines it is feasible and with the advice <br />of the City Attorney. <br />Adopted by the City Council this lst day of April, 1976. <br />Maynard Eder, Mayor <br />Attest: <br />Donald Meltssikomer, Clerk <br />
