R-76-10 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AUTHORIZING FILING OF APPLICATION FOR <br />GRANT TO ACQUIRE AND DEVELOP OPEN SPACE UNDER THE <br />PROVISIONS OF THE FEDERAL LAND AND WATER CONSERVA- <br />TION FUND ACT AND THE STATE NATURAL RESOURCES FUND <br />WHEREAS, the Land and Water Conservation Fund Act and the State Natural <br />Resources Fund Act provide for the making of grants to assist local government <br />in the acquisition and development of outdoor recreation facilities; and <br />WHEREAS, the City of Lake Elmo desires to acquire and develop certain <br />land known as DeMontreville Park, which land is to be held in use for permanent <br />open space; and <br />WHEREAS, Title VI of the Civil Rights Act of 1964 P L 88-354 (1964) and <br />of the Regulations promulgated pursuant to such act by the Secretary of Interior <br />and contained in 43 CFR 17, effectuating that title, provides that no person <br />shall be discriminated against because of race, color, or natural origin in <br />the use of land so acquired and/or developed; and <br />WHEREAS, it is estimated that the cost of acquiring said land shall be <br />$60,000.00: <br />NOW, THEREFORE, SE IT RESOLVED, by the City Council of the City of Lake <br />Elmo: <br />1. That in accordance with previous directions of this Council the City <br />make specific application to the office of Local and Urban Affairs of the State <br />Planning Agency for a grant from the Land and Water Conservation Fund Act as <br />amended in 1965 for an amount presently estimated to be $30,000.00 and the City <br />pay the balance of the cost from other funds now available for such purposes. <br />2. That the Mayor and Clerk of the City of Lake Elmo are hereby authorized <br />and directed to execute and file such application with the Office of Local and <br />Urban Affairs of the Minnesota State Planning Agency and to provide such additional <br />information and to furnish such documents as may be required by said agency, to <br />act as the authorized correspondent of the City with respect to such application. <br />3. That the proposed acquisition is in accordance with City plans for <br />allocation of land for open space uses and that should said grant be made, the <br />applicant will acquire, develop and retain said land for uses designated in <br />the application and approved by the Office of Local and Urban Affairs and the <br />Bureau of Outdoor Recreation. <br />4. That the United States of America and the State of Minnesota be, and <br />they hereby are, assured of full compliance by the applicant with the regula- <br />tions of the Department of Interior, effectuating Title VI of the Civil Rights <br />Act of 1964. <br />Adopted by the City Council this 20th day of April, 1976. <br />Attest.: — <br />Maynard L.
