R-76-11 <br />determined by the Department of Natural Resources to be <br />the permissible level for purposes of the said pumping <br />( permit). <br />(c) The City Engineer determines that continued pumping <br />may result in substantial damage to public and pri- <br />vate property not warranted by the damage to be aver- <br />ted by pumping. <br />d. During any said periods of pumping the City Engineer shall: <br />(a) Monitor water levels on Lake Jane and Sunfish Lake. <br />(b) Initiate and maintain erosion control measures to <br />prevent any detrimental erosion from occurring in <br />or near the areas of pumping - including the exten- <br />sion of the pipes used for pumping South from Lake <br />Jane Trail to keep water from flowing onto the <br />abutting Slinde and Berschens property and the ex- <br />tension of the pipe running into the City Park one <br />pipe length beyond the pipe extension used during <br />the emergency pumping of 1975. <br />(c) Initiate and maintain noise pollution controls in- <br />cluding, but not limited to, the installation of new <br />mufflers on the pump to be used, <br />/ 5. In view of the concern of a substantial number of residents made evident <br />` by the appearances and petitions presented at the said public hearing, the City <br />Council determines that it is important and appropriate to state its intention <br />with respect to the following matters: <br />(a) It is the intention of the City Council, subject to <br />actual determination of benefits received, at the pro- <br />per time in these proceedings, and after an assess- <br />ment hearing, to assess the cost of the project ordered <br />herein against those properties on Lake Jane and areas <br />between Lakes Olson and Jane lying within the flood <br />plain, which properties, at this time, appear to be <br />those which will be preserved in value because of <br />said project and hence benefit substantially and <br />directly therefrom. <br />(b) It is the intention of this Council to continuously <br />review during the course of this project the reports <br />of its Engineer and intervene if necessary to ter- <br />minate the project at such time as it appears to the <br />Council that the purpose of minimizing flood damage <br />will no longer be served by continuing the project <br />or at such time as it appears that any further ease- <br />ments or permits deemed necessary by the City Council <br />to continue the pumping are not expected to be granted <br />to the City as needed or in the event any easements or <br />permits deemed necessary by the City Council for the <br />pumping, and presently available, are revoked or ter- <br />minated by the grantors thereof. <br />
