R-76-17 <br />RESOLUTION <br />CITY OP' LAKE ELMO <br />r <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION PERTAINING TO THE ASSESSMENT OF FLOOD <br />DAMAGED LANDS <br />@' WHEREAS, the City Council of the City of Lake Elmo has reviewed the <br />/ report of its Board of Review relating to the assessment of lands for tax <br />purposes in the City of Lake Elmo and finds a number of requests for re- <br />duction in assessed valuation have been made on the grounds that the property <br />jhas been damaged by flooding in recent years and has, as a result, been <br />reduced in market value; and <br />WHEREAS, the City Council is aware of other areas in Washington County <br />in which property has been damaged by high water; and <br />WHEREAS, the City Council understands that it is the obligation of the <br />1 County to maintain equal valuations and tax assessment procedures with the <br />County: <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Lake Elmo hereby requests that the Washington County Board of Commissioners <br />establish a standard for adjusting values and assessing lakeshore lots <br />which will take into account the effect of flood damage on such property, <br />whether or not improved, and instruct the County Assessor to make such ad- <br />justments as may be appropriate on a County -wide basis but in no case shall <br />a reduction in value be greater than fifteen (15) per cent of the actual market <br />value of the property after taking into account such damage. <br />Adopted by the City Council this 1st day of June, 1976. <br />Maynard L.
