R-76-19.;(A) <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION GRANTING APPLICATION OF CARL OLINGER FOR MINOR SUBDIVISION APPROVAL <br />WHEREAS, Carl F. Olinger and A. Margaret Olinger have made application for <br />minor subdivision approval under the provisions of Section 905 of the Model <br />Subdivision Ordinance for communities in Washington County as adopted by <br />Section 401 of the Lake Elmo Municipal Code of 1974 seeking approval of the <br />City to subdivide certain lands in Government Lot Five (5) in Section Ten (10) <br />in the City of Lake Elmo into three residential lots; and <br />WHEREAS, it appears from the application on file herein, and the report of <br />the City Planning Consultant that the subdivision approval requested by the <br />applicantsfalls within the provisions of Section 905 of said Model Code, and <br />that; <br />1. The proposed subdivision would not result in more than three new lots. <br />2. The conditions in the locality where they are situated are well defined <br />in that the three lots in question would be located between already existing <br />residential lots and the proposed minor subdivision would merely complete <br />an existing neighborhood. Under such conditions it appears that the subdivision <br />proposed by the applicants would result in a reasonable and proper use of the <br />land in keeping with the already established uses in the neighborhood. <br />3. The three newly created lots will conform in all respects to the <br />provisions of the zoning and subdivision ordinances of the City of Lake Elmo. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo <br />that said application of Carl F. and A Margaret Olinger establishing three new <br />lots as a minor subdivision is approved and the said three lots may be <br />subdivided as requested by the application and in accordance with the plans <br />therefore on file with the City Clerk on the following conditions: <br />1. That the new lots be described in Certificate of Survey prepared by <br />registered land survey and certified copies of said registered land survey be <br />filed with the City Clerk. One of such copies shall be maintained at all times <br />in the Clerks record and another copy shall be forwarded to the Valley Branch <br />Watershed District. <br />2. That City Engineer review the proposed subdivision and determine whether <br />any utility, drainage or similar easements are required by the City of Lake Elmo, <br />
