MINUTES OF LAKE ELMO CITY COUNCIL MEETING, AUGUST 2, 1977. <br />Meeting called to order at 7:36 p.m. by Acting Mayor Shervheim. <br />Present: Councilmen Shervheim, Pott & Morgan & Councilwoman Lyons <br />Absent: Mayor Armstrong <br />Also present: Adm. Assistant Whittaker, Bldg. Insp. Mueller, Counsel <br />Raleigh and Engineer Noyes. <br />Richard Bergman---5833 Lake Elmo Ave.No. relative to a mining permit. <br />Plans to remove a hill and prepare land for farming. <br />Already removed 4,000 yds. and there is about 1600 yds. <br />remaining. Earth is not beina moved within the city <br />limits. Reason for removal is to reduce or eliminate <br />an erosion problem. <br />Motion by Councilwoman Lyons 2nd by Councilman Shervheim <br />to approve special permit subject to Fngineer Noyes. <br />making inspection and making final approval. <br />Carried 3-0. Councilman Morgan abstained, Mayor <br />Armstrong absent. <br />Mining Permit: Motion by Councilman Pott 2nd by Councilman Morgan <br />instructing engineer to set up for inspection of <br />current operating permits as soon as reasonable or <br />as soon as pits are thru for season. <br />Carried 4-0. <br />Ralph Oace: Subdivision of. Lot 6, Block 1, Oace's 4th. Addition.' <br />Motion by Councilman Pott 2nd by Councilwoman Lyons <br />to accept Registered Land Survey subject to approval <br />by engineer, counsel and the owner of an easement, <br />to the city, for an appropriate turnaround to be <br />leveled by the owner. Carried. 4-0. <br />Jesse's Hideaway--50th. & Kimbro--Galen Smith <br />Motion by Councilman Pott 2nd by Councilman Morgan <br />to approve final and preliminary plat subject to a <br />development agreement under which, at this time, the <br />abutting property owners will agree to pay for the <br />maintenance on that road (grading, graveling and dust <br />control) as necessary as an assessment. Carried 4-0. <br />Jerry Beach -Forester: Diseased tree program. L. Whittaker adviged that <br />county will continue to reimburse residents at the <br />rate of $25.00 per tree if they supply the supporting_ <br />invoices. City discussed what additional assistance <br />it would offer. <br />Motion by Councilman Morgan 2nd by Councilman Pott to <br />adopt tree disposal program. As part of program city <br />would make application to state for reimbursements of. <br />costs. That the city reimburse residents, in control <br />zones, for cost of disposal which must be substantiated <br />by receipts from the disposal sight. Maximum cost not <br />to exceed $14,000. Carried 4-0. <br />
