R-77-6 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AUTHORIZING JUDICIAL CHALLENGE <br />TO HIGHWAY 12 ALIGNMENT FOR I-94 <br />RESOLVED, that the City of Lake Elmo, acting through its duly <br />elected Council in response to the requests of a substantial number <br />of its citizens, does hereby declare its intention to join in a <br />formal judicial (and/or administrative) challenge of the selection <br />of the present Highway 12 alignment for I-94, and agrees to the <br />expenditure of up to $5,000.00 of the City's general revenue funds <br />for such purpose, provided that unless additional commitments are <br />received by July 1, 1977, from Washington County, other municipalities, <br />corporate and/or individual donors which, when aggregated with Lake <br />Elmo's above commitment, will total at least $50,000 (the amount <br />expected to be sufficient to carry such challenge through the trial <br />court stage) this authorization shall be void; and <br />RESOLVED FURTHER, that Councilmen Lloyd Shervheim and Francis <br />J. Pott be and each hereby is authorized to represent the City in <br />this effort, to sign on behalf of the City such pleadings and docu- <br />ments in form satisfactory to the City Attorney, as may in their <br />judgment be necessary or desirable in connection therewith, and to <br />authorize the disbursement of City monies therefor with the limits <br />hereinabove stated. <br />Adopted by the City Council this 7th day of June, 1977. <br />Thomas G.
