R-77-1 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION VACATING CERTAIN PUBLIC EASEMENTS IN <br />THE PLAT OF EDEN PARK (PAQUIN PETITION) <br />WHEREAS, at a regular meeting of the City Council of the City of Lake Elmo, <br />Washington County, Minnesota, held December 7, 1976, a petition was presented by <br />Richard E. Paquin and Pearl M. Paquin, husband and wife, praying for the vacation <br />of certain public easements in the plat of Eden Park described as follows: <br />That part of Lots Six (6) and Seven (7), Block Two (2),EDEN PARK, <br />according to the plat thereof on file and of record inthe office <br />of the County Recorder, Washington County, Minnesota, described <br />as follows: The southerly 6.0 feet of said Lot Six (6) lying <br />easterly of the westerly 30.0 feet and, also, the northerly 6.0 <br />feet of said Lot Seven (7) lying easterly of the westerly 30.0 <br />feet, <br />which easements are utility and drainage easements. <br />WHEREAS, said petition came on for hearing before the City Council at a <br />regular meeting thereof held at 8:00 o'clock p.m. in the City Hall on January 18, <br />1977, pursuant to notice thereof published and posted as required by law; and <br />WHEREAS, the City Council of the City of Lake Elmo has heard all of the <br />evidence presented for said petition, there being no objection thereto or no <br />evidence presented against it, and after due consideration thereof, has deter- <br />mined that it is in the best interests of the public and the City of Lake Elmo <br />to vacate said easement for the following reasons: <br />1. The lands sought to be vacated as above described are of no use to the <br />City or the public, generally, because the Paquins' house has been located on the <br />easement and it would be impossible to use the easement for its intended purpose. <br />2. It is in the public interest to have such drainage utility easements re- <br />moved from the land records where they are of no actual value to the City and where, <br />such as here, the recorded easements may be of substantial detriment to private <br />property. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo, <br />that the following described lands: <br />That part of Lots Six (6) and Seven (7), Block Two (2), EDEN PARK, <br />according to the plat thereof on file and of record in the office <br />of the County Recorder, Washington County, Minnesota, described <br />as follows: The southerly 6.0 feet of said Lot Six (6) lying <br />easterly ofthe westerly 30.0 feet and, also, the northerly 6.0 <br />feet of said Lot Seven (7) lying easterly of the westerly 30.0 <br />feet, <br />be and the same hereby are vacated absolutely and forever for the reasons set <br />forth above herein. <br />
