IT IS FURTHER RESOLVED, that the City Council does hereby determine that <br />the City is deemed to benefit from said vacation for the reasons set forth above <br />and the same are sufficient consideration for the vacation thereof. Provided, <br />however, (1) that if required by the City Engineer, the Paquins shall, as a condi- <br />tion of this vacation, provide a new utility and drainage easement along the <br />southerly 6.0 feet of their property and shall secure a like easement of 6.0 feet <br />along the northerly,6.0 feet of the tract of land lying immediately to the south <br />of and adjacent to the Paquins' property; (2) that all the costs to the City of <br />this vacation proceeding shall be calculated by the Clerk and shall be paid by <br />the petitioners or their assigns to the Clerk. Upon payment of said costs by <br />the petitioners,and dedicating of a new easement if required by the City Engineer <br />or waiver thereof by the City Engineer, the Clerk shall cause notice to be served <br />on the County Auditor that this vacation proceeding has been concluded and shall <br />record a certified copy of this Resolution with the County Recorder, all as pro- <br />vided by and in accordance with section 412.851 of the Minnesota Statutes. <br />Adopted by the City Council of the City of Fake Elmo, this 18th day of <br />January, 1977. <br />THOMAS G.
