IT IS FURTHER RESOLVED, that the City Council does hereby determine that the City is deemed to benefit from said vacation for the reasons set forth above and the same are sufficient consideration for the vacation thereof. Provided, however, (1) that if required by the City Engineer, the Paquins shall, as a condi- tion of this vacation, provide a new utility and drainage easement along the southerly 6.0 feet of their property and shall secure a like easement of 6.0 feet along the northerly,6.0 feet of the tract of land lying immediately to the south of and adjacent to the Paquins' property; (2) that all the costs to the City of this vacation proceeding shall be calculated by the Clerk and shall be paid by the petitioners or their assigns to the Clerk. Upon payment of said costs by the petitioners,and dedicating of a new easement if required by the City Engineer or waiver thereof by the City Engineer, the Clerk shall cause notice to be served on the County Auditor that this vacation proceeding has been concluded and shall record a certified copy of this Resolution with the County Recorder, all as pro- vided by and in accordance with section 412.851 of the Minnesota Statutes.
