R--77-2 <br />RESOLUTION <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION VACATING CERTAIN PUBLIC STREETS IN <br />BERGMANN'S ADDITION (MOTTAZ PETITION) <br />WHEREAS, at a regular meeting of the City Council of the City of Lake Elmo, <br />Washington County, Minnesota, held February 15, 1977, a petition was presented to <br />the City Council praying for the vacation of certain public streets in the plat <br />of Bergmann Addition described as follows: <br />All those streets and parts of streets dedicated as part of the <br />plat of BERGMANN ADDITION and described in said plat as follows: <br />"Alice Lane", "Violet Lane", and that portion of "Lucille Lane" <br />lying between the south boundary of Lot Six (6), Block Two (2) <br />and the north boundaries of the West 78.4 feet of Lot Fourteen <br />(14), Lot Thirteen (13) and the East 81.7 feet of Lot Twelve <br />(12), Block One (1), of said BERGMANN ADDITION, <br />WHEREAS, said petition came on for hearing before said City Council at a <br />regular meeting thereof held at 5:00 o'clock p.m. on March 15, 1977, pursuant to <br />notice thereof published and posted as required by law; and <br />WHEREAS, the City Council of the City of Lake Elmo has heard all the evidence <br />presented for said petition, there being no objection thereto, and no evidence pre- <br />sented against said vacation, and after due consideration thereof has determined <br />that it is in the best interests of the public and the City of Lake Elmo to vacate <br />said streets for the following reasons: <br />1. That the streets serve no purpose at this time and are not included as <br />part of the overall transportation system outlined in the City's Comprehensive Plan. <br />2. If the petition for vacation is granted it will preclude the potential <br />use of these streets by the public which use would be inconsistent with the trans- <br />portation plans of the City of Lake Elmo. Moreover, the vacation of said streets <br />would return the property included within their right-of-way to the tax rolls and <br />would enhance the value of the abutting property on the tax rolls all of which re- <br />sults in a benefit to the public. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo, <br />that the following described streets: <br />All those streets and partsof streets dedicated as part of the <br />plat of BERGMANN ADDITION and described in said plat as follows: <br />"Alice Lane", "Violet Lane", and that portion of "Lucille Lane" <br />lying between the south boundary of Lot Six (6), Block Two (2) <br />and the north boundaries of the West 78.4 feet of Lot Fourteen <br />(14), Lot Thirteen (13) and the East 81.7 feet of Lot Twelve <br />(12), Block One (1) of said BERGMANN ADDITION, <br />be and the same hereby are vacated absolutely and forever for the reasons set <br />forth above herein. <br />
